2. Objet

Les présentes Conditions Générales (ci-après “CG”) définissent les droits et obligations de Phoenix Heaven Events et des participants (ci-après “Participants”) dans le cadre de la vente de billets et de la participation aux événements organisés par Phoenix Heaven Events, qu’il s’agisse de bals, de festivals, de spectacles, d’ateliers, de retraites immersives ou de toute autre activité culturelle ou artistique.

3. Billetterie

Les billets sont disponibles via Infomaniak et sont valables uniquement pour la date et l’événement indiqués.
Les prix sont exprimés en francs suisses (CHF) et incluent la TVA si applicable.
La confirmation d’achat et le billet électronique sont envoyés par email après paiement complet.

4. Conditions d’annulation, de remboursement et de revente

Annulation par le Participant :
Aucun remboursement n’est accordé sauf si une assurance annulation a été souscrite via la plateforme de billetterie, auquel cas la demande doit être adressée directement à l’assureur.
Annulation ou modification par l’Organisateur :
En cas d’annulation totale de l’événement, Phoenix Heaven Events proposera soit un remboursement intégral, soit un avoir valable pour un autre événement.
En cas de modification substantielle (date, lieu, format), les Participants seront informés et pourront demander un remboursement.
Revente des billets :
La revente de billets est strictement autorisée uniquement via la plateforme sécurisée Tixel. Toute revente par d’autres moyens ou à un prix supérieur à la valeur faciale est interdite et pourra entraîner l’invalidation du billet sans remboursement.

5. Conditions de participation

Âge minimum : 18 ans révolus le jour de l’événement. Une pièce d’identité pourra être demandée à l’entrée.
Dress code : Tenue conforme au thème (historique ou fantasy) exigée. L’organisateur se réserve le droit de refuser l’entrée en cas de non-respect.
Comportement : Les Participants doivent adopter un comportement respectueux envers le personnel, les artistes et les autres invités.

6. Responsabilité

Phoenix Heaven Events décline toute responsabilité pour les dommages corporels, matériels ou pertes subis lors de l’événement, sauf en cas de faute grave ou intentionnelle de sa part.
L’Organisateur n’est pas responsable des réservations de transport ou d’hébergement effectuées par les Participants.

7. Droit à l’image

En participant à l’événement, le Participant autorise l’Organisateur à utiliser, sans contrepartie, les photos et vidéos dans lesquelles il pourrait apparaître, à des fins promotionnelles et de communication, sur tout support.

8. Force majeure

Phoenix Heaven Events ne pourra être tenu responsable si l’événement doit être annulé ou modifié en raison de circonstances indépendantes de sa volonté (catastrophe naturelle, pandémie, décision administrative, etc.).

9. Droit applicable et juridiction

Les présentes CG sont régies par le droit suisse. En cas de litige, les tribunaux du canton du siège de Phoenix Heaven Events sont seuls compétents.

2. Purpose

These General Terms and Conditions (“GTC”) define the rights and obligations of Phoenix Heaven Events and the participants (“Participants”) in the context of ticket sales and participation in events organised by Phoenix Heaven Events, whether balls, festivals, shows, workshops, immersive retreats, or any other cultural or artistic activity.

3. Ticketing

Tickets are available via Infomaniak and are valid only for the date and event specified.
Prices are stated in Swiss francs (CHF) and include VAT where applicable.
Purchase confirmation and the electronic ticket are sent by email after full payment.

4. Cancellation, Refund, and Resale Policy

Cancellation by the Participant:
No refunds will be granted unless cancellation insurance has been purchased via the ticketing platform, in which case the request must be made directly to the insurer.
Cancellation or modification by the Organiser:
In the event of total cancellation of the event, Phoenix Heaven Events will offer either a full refund or a credit valid for another event.
In the event of a substantial modification (date, location, format), Participants will be informed and may request a refund.
Ticket resale:
Ticket resale is strictly authorised only via the secure platform Tixel. Any resale by other means or at a price higher than the face value is prohibited and may result in the ticket being invalidated without refund.

5. Participation Conditions

Minimum age: 18 years on the day of the event. ID may be requested upon entry.
Dress code: An outfit matching the event theme (historical or fantasy) is required. The organiser reserves the right to refuse entry in case of non-compliance.
Behaviour: Participants must behave respectfully towards staff, artists, and other guests.

6. Liability

Phoenix Heaven Events accepts no liability for bodily injury, material damage, or loss incurred during the event, except in cases of gross negligence or intentional misconduct.
The Organiser is not responsible for travel or accommodation bookings made by Participants.

7. Image Rights

By participating in the event, the Participant authorises the Organiser to use, without compensation, any photos or videos in which they may appear, for promotional and communication purposes, on any medium.


8. Force Majeure

Phoenix Heaven Events shall not be held liable if the event must be cancelled or modified due to circumstances beyond its control (natural disaster, pandemic, administrative decision, etc.).


9. Governing Law and Jurisdiction

These GTC are governed by Swiss law. In the event of a dispute, the courts of the canton in which Phoenix Heaven Events has its registered office shall have exclusive jurisdiction.

2. Betreff

Die vorliegenden Allgemeinen Geschäftsbedingungen (nachfolgend „AGB“) legen die Rechte und Pflichten von Phoenix Heaven Events und den Teilnehmern (nachfolgend „Teilnehmer“) im Zusammenhang mit dem Verkauf von Eintrittskarten und der Teilnahme an Veranstaltungen fest, die von Phoenix Heaven Events organisiert werden, unabhängig davon, ob es sich um Bälle, Festivals, Shows, Workshops, immersive Retreats oder andere kulturelle oder künstlerische Aktivitäten handelt.

3. Ticketverkauf

Die Tickets sind über Infomaniak erhältlich und gelten nur für das angegebene Datum und die angegebene Veranstaltung.
Die Preise sind in Schweizer Franken (CHF) angegeben und enthalten die gesetzliche Mehrwertsteuer, sofern zutreffend.
Die Kaufbestätigung und das E-Ticket werden nach vollständiger Bezahlung per E-Mail versandt.

4. Annullierungs-, Rückerstattungs- und Weiterverkaufsbedingungen

Annullierung durch den Teilnehmer:
Es wird keine Rückerstattung gewährt, es sei denn, über die Ticketplattform wurde eine Annullierungsversicherung abgeschlossen. In diesem Fall muss der Antrag direkt an den Versicherer gerichtet werden.
Annullierung oder Änderung durch den Veranstalter:
Im Falle einer vollständigen Absage der Veranstaltung bietet Phoenix Heaven Events entweder eine vollständige Rückerstattung oder eine Gutschrift für eine andere Veranstaltung an.
Im Falle einer wesentlichen Änderung (Datum, Ort, Format) werden die Teilnehmer informiert und können eine Rückerstattung beantragen.
Weiterverkauf von Tickets:
Der Weiterverkauf von Tickets ist ausschließlich über die gesicherte Plattform Tixel gestattet. Jeder Weiterverkauf auf andere Weise oder zu einem Preis über dem Nennwert ist verboten und kann zur Ungültigkeit der Eintrittskarte ohne Rückerstattung führen.

5. Teilnahmebedingungen

Mindestalter: 18 Jahre am Tag der Veranstaltung. Am Eingang kann ein Ausweis verlangt werden.

Kleiderordnung: Dem Thema (Geschichte oder Fantasy) entsprechende Kleidung ist erforderlich. Der Veranstalter behält sich das Recht vor, bei Nichteinhaltung den Zutritt zu verweigern.

Verhalten: Die Teilnehmer müssen sich gegenüber dem Personal, den Künstlern und den anderen Gästen respektvoll verhalten.

6. Haftung

Phoenix Heaven Events lehnt jede Haftung für Personen- oder Sachschäden oder Verluste ab, die während der Veranstaltung entstehen, außer im Falle eines groben oder vorsätzlichen Verschuldens seinerseits.
Der Veranstalter ist nicht verantwortlich für Transport- oder Unterkunftsbuchungen, die von den Teilnehmern vorgenommen werden.

7. Bildrechte

Mit der Teilnahme an der Veranstaltung ermächtigt der Teilnehmer den Veranstalter, Fotos und Videos, auf denen er möglicherweise zu sehen ist, ohne Gegenleistung für Werbe- und Kommunikationszwecke auf allen Medien zu verwenden.

8. Höhere Gewalt

Phoenix Heaven Events kann nicht haftbar gemacht werden, wenn die Veranstaltung aufgrund von Umständen, die außerhalb seiner Kontrolle liegen (Naturkatastrophen, Pandemien, behördliche Entscheidungen usw.), abgesagt oder geändert werden muss.

9. Anwendbares Recht und Gerichtsbarkeit

Die vorliegenden AGB unterliegen schweizerischem Recht. Im Falle von Streitigkeiten sind ausschließlich die Gerichte des Kantons zuständig, in dem Phoenix Heaven Events seinen Sitz hat.

2. Oggetto
Le presenti Condizioni Generali (di seguito “CG”) definiscono i diritti e gli obblighi di Phoenix Heaven Events e dei partecipanti (di seguito “Partecipanti”) nell'ambito della vendita di biglietti e della partecipazione agli eventi organizzati da Phoenix Heaven Events, che si tratti di balli, festival, spettacoli, workshop, ritiri immersivi o qualsiasi altra attività culturale o artistica.

3. Biglietteria
I biglietti sono disponibili tramite Infomaniak e sono validi solo per la data e l'evento indicati.
I prezzi sono espressi in franchi svizzeri (CHF) e includono l'IVA, se applicabile.
La conferma dell'acquisto e il biglietto elettronico vengono inviati via e-mail dopo il pagamento completo.

4. Condizioni di cancellazione, rimborso e rivendita
Cancellazione da parte del Partecipante:
Non è previsto alcun rimborso, salvo nel caso in cui sia stata stipulata un'assicurazione di cancellazione tramite la piattaforma di biglietteria, nel qual caso la richiesta deve essere indirizzata direttamente all'assicuratore.

Cancellazione o modifica da parte dell'Organizzatore:
In caso di cancellazione totale dell'evento, Phoenix Heaven Events offrirà un rimborso completo o un buono valido per un altro evento. In caso di modifiche sostanziali (data, luogo, formato), i Partecipanti saranno informati e potranno richiedere un rimborso.

Rivendita dei biglietti:
La rivendita dei biglietti è consentita esclusivamente tramite la piattaforma sicura Tixel. Qualsiasi rivendita con altri mezzi o a un prezzo superiore al valore nominale è vietata e potrà comportare l'invalidazione del biglietto senza rimborso.

5. Condizioni di partecipazione
Età minima: 18 anni compiuti il giorno dell'evento. All'ingresso potrà essere richiesto un documento d'identità.
Dress code: è richiesto un abbigliamento conforme al tema (storico o fantasy). L'organizzatore si riserva il diritto di rifiutare l'ingresso in caso di mancato rispetto.
Comportamento: i partecipanti devono adottare un comportamento rispettoso nei confronti del personale, degli artisti e degli altri ospiti.

6. Responsabilità
Phoenix Heaven Events declina ogni responsabilità per danni fisici, materiali o perdite subiti durante l'evento, salvo in caso di colpa grave o intenzionale da parte sua.
L'Organizzatore non è responsabile delle prenotazioni di trasporto o alloggio effettuate dai Partecipanti.

7. Diritto all'immagine
Partecipando all'evento, il Partecipante autorizza l'Organizzatore a utilizzare, a titolo gratuito, le foto e i video in cui potrebbe apparire, a fini promozionali e di comunicazione, su qualsiasi supporto.

8. Forza maggiore
Phoenix Heaven Events non potrà essere ritenuta responsabile se l'evento dovesse essere annullato o modificato a causa di circostanze indipendenti dalla sua volontà (catastrofi naturali, pandemie, decisioni amministrative, ecc.).

9. Diritto applicabile e giurisdizione
Le presenti CG sono regolate dal diritto svizzero. In caso di controversia, saranno competenti esclusivamente i tribunali del cantone in cui ha sede Phoenix Heaven Events.
